What is a Real Estate Agent and what agency responsibilities it has to buyers and sellers?

There are extensive laws and regulations in California to regulate the conduct of a Real Estate Agents and Brokers. Some of these regulations are from Department of Real Estate and some of them are from California state laws regarding agency relationship. There are also set of rules of ethics and ethical conducts that members of association of realtors have to abide by.

Lets talk first about Listing agent responsibilities toward sellers in the first place and buyers in second place. But before doing that lets clarify a term that is always misused both by professional agents and by ordinary people.

The term is "buyers agent". In 99% of the cases when somebody says "buyers agent", what he really means is "Selling Agent". These two terms have substantially different consequences for you and your pocket. First of all if you really want a "buyers agent" you have to be ready to pay thousands of dollars to hire a buyers agent. In my opinion that is waist of money. Why?

The reason is paying somebody to look for properties for you in a market that 95% of the properties are listed. This does not open new venues for you as far as substantial increased inventory of the houses you can choose from. Is there any other reason you want to have a buyers agent, technically yes but in practice no, that is if you are smart enough and do not deal with listing agents. Let me explain, how avoiding to deal with listing agents can increase your chances to get a better deal.

One reason that you are generally better off not to deal with listing agent is that by law that have to look for the interest of sellers. Of course there are conflict of interests between the buyers and sellers. The point is when listing agent has to decide who should pay a certain part of closing cost or other costs a savvy seller might dictate to listing agents what he want him to do and by law the real estate agent has to abide.

If you go to an agent and want him to find properties for you, this "selling agent" has no obligation to any seller until a contract is formed. So from a legal point of view he can look after your interest when he writes an offer and by doing this he is not breaking any agency laws.

Let me explain, the matter is little bit complicated and there is a fine line between correct way and wrong way of purchasing homes and what a selling agent can do and can not do. That fine line might end up costing unaware buyer of a home thousands of dollars in extra costs, if you as buyer are completely unaware of laws of agencies.

Lets investigate what burdens laws of agency puts on listing agents. First of all listing agents should communicate information that seller allowed them to communicate to buyers. Although a listing agent should be truthful both to seller and buyer, it does not mean he has to tell everything. He has to tell very little to buyers, by law only material facts should be reviled to buyers. What is material fact and what is not material fact can be content of a book with couple of hundred pages. The listing agents can basically consider the information as non-material facts when they are in gray zone and just keep his mouth closed. If you insist, they will recommend you to hire a few professional, lawyers and tax advisers. 99% of the people are not ready to spend a few thousands dollars just to get some simple information.

On the other hand when you asked an independent agent to look for properties for you, he can compare and choose the ones with best price and features and he has no obligation to any of the sellers he compare their houses. Going to a listing agent to shop around is like to go to a small shop with a few items for sale, and the shop owner by law cannot tell you there is another better shop with better merchandise right around corner.

The problem is that any agent that you go to has a couple of homes listed and they try to sell them to you. Just tell them what you want is substantially different. If by any chance a listing agent shows a house that is perfect for you, go to another independent agent and ask him to see if there is another house with better features and price in the same neighborhood. If he could not find better deal for you, let the independent agent write you an offer, he most likely doing a better job taking care of you interests.

One last word about choosing right selling agent. If you went to a house with a selling agent and he try to push you to purchase the house, do not deal with him. Let another agent write you the offer. Why? Because that agent just see a dollar sign and he will put anything in the offer just to make it attractive and collect his commission. It is hard to find an agent to take care of the buyers interests and at the same time follow the California Real Estate Agency laws.
